Terms of Service
Service Description
North Lawn Care provides residential lawn maintenance services which may include:
- Lawn mowing
- String trimming
- Lawn edging
- Blowing and clearing grass clippings from driveways, sidewalks, patios, and other hard surfaces
Services are provided as a flat-rate package unless otherwise specified.
Service offerings, pricing, and package structure may be modified at any time without prior notice.
Service Area
Services are currently offered within select neighborhoods in and around the 14043 and 14086 area.
North Lawn Care reserves the right to decline service requests that fall outside of our designated service area or outside of our established service routes.
Service Schedule
North Lawn Care operates on a Monday through Saturday service schedule. By requesting service, customers acknowledge and agree to the following:
- Standard Operating Hours: Services are performed Monday through Saturday, typically between 8:00 am and 6:00 pm.
- Extended Service Window: To ensure all properties are serviced, we may continue operations past 6:00 pm if sunlight and safety conditions permit.
- Scheduling & Timing: Exact service times cannot be guaranteed. Our service order is determined strictly by route efficiency.
- Operational Factors: Schedule changes may occur due to weather conditions, equipment maintenance, route adjustments, or other unforeseen operational factors.
- Weather & Safety Rescheduling: If service cannot be performed due to rain or unsafe lawn conditions, the visit may be rescheduled for the next available service day or skipped for the week, depending on current route capacity and conditions.
Weekly Subscription Plan
Customers may enroll in a weekly lawn service subscription for the mowing season. Subscription terms include:
- Recurring lawn maintenance during the active lawn care season
- A 15% discounted rate compared to one-time service pricing
- Automatic recurring billing through our payment processor
Auto-Renewal Disclosure: Subscriptions renew automatically each week at the then-current subscription rate and will continue until cancelled. You will be charged after each service is completed, typically on the same day the work is performed. The exact subscription rate in effect at the time of each billing cycle will be applied. To cancel before the next billing cycle, contact us at (716) 393-9597 prior to your scheduled service date. Cancellation requests received after a service has been performed will take effect for the following billing cycle.
Subscription services are intended for lawns that receive consistent weekly maintenance.
Payment Terms
All payments are processed securely through Stripe. Please note that we do not accept cash or check payments. Our payment policies include:
- Initial Sign-Up: For new customers, payment is required before the first service is performed.
- One-Time Services: Payment for individual, non-recurring services must be completed in full prior to the service being performed.
- Recurring Subscriptions: Subscription plans are billed after service has been completed, typically on the same day the work is performed.
- Payment Failure: Failure to complete payment may result in the cancellation of scheduled services, suspension or termination of subscription plans, or denial of future service requests.
Late Fees & Interest
Invoices or subscription charges that remain unpaid for more than 7 days past the due date will be subject to a $15.00 flat late fee, plus interest accruing at a rate of 1.5% per month (18% annually) on the outstanding balance. Interest begins accruing on the 8th day after the original due date and continues until the balance is paid in full.
Non-Payment & Collections
If a balance remains unpaid, North Lawn Care will pursue collection in the following order:
- Step 1 — Service Suspension: All scheduled services, including active weekly subscriptions, will be immediately paused until the outstanding balance, including any applicable late fees and accrued interest, is paid in full. North Lawn Care reserves the right to deny future service bookings to any customer with an outstanding balance.
- Step 2 — Demand Letter: If the balance is not resolved within 7 days of service suspension, North Lawn Care will issue a formal written demand letter sent via certified mail with return receipt to the customer's address on file. This letter will state the total amount owed, provide a payment deadline of 10 days from the date the letter is sent, and outline the consequences of continued non-payment.
- Step 3 — Collections & Credit Reporting: If payment is not received within the window specified in the demand letter, North Lawn Care reserves the right to refer the outstanding balance to a third-party collections agency, report the delinquent account to one or more consumer credit reporting bureaus, and pursue recovery of the unpaid balance, late fees, interest, and any reasonable collections or legal costs through Small Claims Court in Erie County, New York, as permitted under Section 20 of these Terms.
Collection Costs: Customers who allow balances to reach the collections stage agree to be responsible for any reasonable costs incurred by North Lawn Care in recovering the debt, including collections agency fees and court filing fees, to the extent permitted by New York law.
Payment Plans: North Lawn Care may, at its sole discretion, offer a payment arrangement to resolve an outstanding balance. Any such arrangement must be agreed to in writing. Entering into a payment plan does not waive North Lawn Care's right to pursue the full balance if the customer fails to honor the agreed payment schedule.
Refund Policy
North Lawn Care's refund policy is as follows:
- Prepaid One-Time Services: If a prepaid one-time service cannot be completed due to weather, inaccessibility, force majeure, or circumstances beyond either party's reasonable control, and cannot be rescheduled within the current service week, a full refund will be issued to the original payment method within 5–7 business days.
- Subscription Services: Because subscription customers are only billed after service is completed, no charge is applied for skipped or missed visits. There is nothing to refund for services that were not performed.
- Completed Services: Refunds will not be issued for services that were completed as described under these Terms. If you have a concern about the quality of a completed service, please contact us within 48 hours and we will work to resolve the issue.
- Partial Refunds: Partial refunds may be issued at the sole discretion of North Lawn Care in cases where a service was only partially completed through no fault of the customer.
Customer Responsibilities
Customers are responsible for maintaining property conditions that allow safe and efficient lawn maintenance. Prior to scheduled service, customers must:
- Remove toys, hoses, lawn decorations, tools, and other objects from the lawn
- Secure pets indoors or within fenced areas away from the service area
- Ensure gates are unlocked if lawn access is required
- Clearly mark hidden obstacles such as sprinkler heads, irrigation systems, wires, or stakes
Customers are also responsible for removing pet waste (pet scat) from the lawn prior to service.
Property Safety & Personal Injury: The customer assumes responsibility for the safety of their property for all individuals conducting authorized service visits. North Lawn Care crew members are authorized to be on the property solely for the purpose of performing the scheduled lawn care service. The customer is responsible for ensuring that the property does not contain known hazards — including unrestrained animals, unstable structures, exposed wiring, or similar dangers — that could cause injury to our crew. North Lawn Care is not liable for personal injury to crew members or third parties arising from undisclosed or concealed property hazards. Customers agree to indemnify and hold harmless North Lawn Care LLC for any injury or loss resulting from hazardous property conditions that were not disclosed prior to service.
Lawn Size Limit
Flat-rate mowing services are intended for typical residential lawns up to approximately 1/2 acre.
Properties exceeding this size may require custom pricing, additional service charges, or may be declined for service. North Lawn Care reserves the right to determine whether a property exceeds standard service parameters.
Property Conditions
The flat-rate service assumes a reasonably maintained lawn. To ensure the best results and maintain our schedule, we require the lawn to be ready for service prior to our arrival. Additional charges, service delays, or refusal of service may occur if:
- Grass height exceeds approximately 8 inches.
- The lawn contains excessive debris, toys, hoses, or pet waste.
- Access is restricted (e.g., locked gates or blocked entryways).
- Property conditions present safety risks.
Property Readiness: Customers are responsible for clearing the lawn of all personal items and pet waste. While North Lawn Care may, at our discretion, move small items as a courtesy to complete the service, we are not responsible for damage to any items left within the service area.
Projectile Hazards: Lawn mowing and trimming equipment can propel rocks, debris, and other objects at high velocity. The customer is responsible for removing or clearly marking all such hazards prior to service. North Lawn Care is not liable for incidental damage caused by objects propelled by mowing or trimming equipment — including damage to windows, siding, vehicles, fencing, or other property — when those objects were present within the service area and were not disclosed, removed, or marked by the customer prior to service.
Weather & Environmental Conditions
Lawn care services are strictly dependent on safe and suitable weather conditions. To protect the health of your turf and the safety of our crew, service may be delayed or rescheduled due to:
- Precipitation: Active rain, thunderstorms, or lightning.
- Saturated Ground: Flooded or excessively wet lawns where equipment may cause soil compaction or turf damage (rutting).
- Severe Weather: High-wind events, extreme heat warnings, or other hazardous conditions.
Rescheduling Logic: When weather interruptions occur, we will make every effort to catch up within the current work week. This may involve utilizing our extended service window (operating past 6:00 pm if sunlight allows). If service cannot be safely completed, the visit may be moved to the next available service day or skipped for the week, depending on current route capacity and ground conditions.
Access to Property
Customers must ensure that their property is accessible during our service window (Monday through Saturday, 8:00 am to 6:00 pm). If our crew cannot safely access the service area due to locked gates, unrestrained pets, or significant obstructions, the service will be skipped.
- No-Charge Policy: If a service is skipped due to access issues, you will not be charged for that visit. While we do not bill for skipped appointments, we ask that you ensure the property is ready to help us maintain our route efficiency.
- Rescheduling: Because our routes are tightly optimized, we cannot guarantee a return visit in the same week if we are blocked from the property. In most cases, service will resume on your next regularly scheduled service day.
- Service Termination: We understand that things happen; however, repeated inability to access the property (e.g., gates left locked multiple weeks in a row) may result in the cancellation of your subscription or future services.
Note: For the safety of our crew and your animals, please ensure all pets are secured indoors or away from the service area during your scheduled service week.
Cancellation Policy
Customers may cancel services or pause subscription plans at any time. To help us maintain an efficient route, we ask that you observe the following:
- Advance Notice: Cancellation requests should be submitted prior to your scheduled service date.
- Subscription Cancellations: Cancellations for recurring plans will take effect before the next billing cycle. Since we bill after service, you will only be responsible for any work already completed.
- Late Cancellations: If a cancellation occurs after the route has been scheduled or once the crew has arrived, the service will be skipped. We do not charge for skipped appointments; however, we reserve the right to terminate service agreements for customers who frequently cancel with little or no notice.
Our goal is to provide reliable service to all our neighbors. Proper notice allows us to offer your time slot to another customer on our waiting list.
Right to Terminate Service
North Lawn Care reserves the right to decline, suspend, or terminate service for any property at any time and for any reason. In the event of service termination, the customer will remain responsible for payment of any services already completed prior to the termination date.
Media Release & Marketing
By receiving services from North Lawn Care, customers grant the Company permission to photograph or record video of the property for business and marketing purposes. These materials may include before-and-after lawn photos, general lawn care footage, and property views showing work in progress.
Photos and video may be used without further compensation to the customer for company website content, social media posts, marketing materials, online advertising, and video platforms such as YouTube.
Yard Sign Permission
As part of our local marketing efforts, customers grant North Lawn Care permission to place a small, temporary yard sign on the property for promotional purposes.
- Placement: Signs are typically placed in a non-obtrusive location near the street or driveway.
- Duration: Signs may remain for a reasonable promotional period. You are welcome to remove and recycle the sign at your convenience once our team has departed.
- Opt-Out: We respect your preference; customers may opt out of yard sign placement at any time by contacting us or simply notifying the crew.
Liability & Damage Policy
North Lawn Care takes reasonable care while performing services. To help us protect your property, please ensure all obstacles are cleared or clearly marked. The Company is not responsible for damage caused by:
- Hidden or Unmarked Obstacles: This includes toys, tools, rocks, metal stakes, or debris hidden in tall grass.
- Projectile Damage: Objects propelled by mowing or trimming equipment — including rocks, sticks, or debris — that were present in the service area and not removed or marked by the customer prior to service. This includes damage to windows, siding, vehicles, fencing, or surrounding structures.
- Unmarked Systems: Irrigation heads, sprinkler systems, "invisible" pet fences, or shallow-buried utility lines (such as fiber optic or landscape lighting) that have not been clearly marked.
- Property Condition: Pre-existing damage to fencing, siding, or turf, as well as damage resulting from unsafe lawn conditions or "rutting" on saturated ground.
- Incidental Contact: Minor contact with items left within the service area (hoses, lawn furniture, etc.) that our crew may move as a courtesy.
- Personal Injury from Property Hazards: Injury to crew members or third parties arising from undisclosed or concealed property hazards, unrestrained animals, or unsafe conditions not reported by the customer prior to service.
Limitation of Liability
To the fullest extent permitted by law, North Lawn Care shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or website.
- Maximum Liability: Our total liability for any claim shall not exceed the total amount paid by the customer for the specific service date giving rise to the claim.
- Third-Party Damage: We are not liable for damages caused by third parties, weather events, or existing property conditions.
Force Majeure
North Lawn Care shall not be liable for any delay or failure to perform services resulting from circumstances beyond our reasonable control. Such circumstances include, but are not limited to:
- Acts of God: Natural disasters, flooding, earthquakes, or other extraordinary weather events beyond normal seasonal conditions.
- Equipment: Unexpected equipment failure, theft of equipment, or inability to obtain parts or replacements within a reasonable timeframe.
- Labor & Supply: Labor shortages, supply chain disruptions, or inability to secure necessary materials or fuel.
- Government & Public Health: Government orders, declared states of emergency, public health directives, pandemics, or other regulatory restrictions affecting our ability to operate.
- Other Unforeseen Events: Any other event outside of North Lawn Care's reasonable control that makes performance impractical or impossible.
In the event of a force majeure, North Lawn Care will make reasonable efforts to notify affected customers and reschedule services as soon as conditions permit. No refunds will be owed for services that could not be performed solely due to a qualifying force majeure event; however, prepaid services affected by such events will be rescheduled or credited at our discretion.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
Any legal action or proceeding arising out of or related to these Terms, or the services provided by North Lawn Care, shall be brought exclusively in the state or federal courts located in Erie County, New York. By using our services or website, you hereby consent to the personal jurisdiction and venue of such courts and waive any objection to the laying of venue in Erie County, New York.
Dispute Resolution & Arbitration Agreement
This section governs how disputes between you and North Lawn Care LLC are resolved. Please read it carefully — it affects your legal rights.
Informal Resolution First
Before filing any formal claim, both parties agree to attempt informal resolution. The complaining party must send written notice to hello@thenorthlawncare.com describing the issue and the desired resolution. Both parties agree to allow 30 days to attempt a good-faith resolution before pursuing any other remedy.
Binding Arbitration (Primary Method)
Except for matters eligible for Small Claims Court (see below), any dispute, claim, or controversy arising out of or relating to services, billing, scheduling, property damage, contract terms, or the relationship between the parties shall be resolved exclusively through final and binding arbitration. This includes:
- Contract disputes
- Service quality complaints
- Property damage claims
- Billing or charge disputes
- Misrepresentation claims
- Any statutory or common-law claims
By agreeing to these Terms, you waive the right to file a lawsuit in court or have a jury trial for any covered dispute.
Small Claims Court Exception
Either party may bring an individual claim in Small Claims Court in Erie County, New York if the claim qualifies under that court's jurisdictional limits. This exception exists so North Lawn Care may efficiently pursue unpaid invoices, and so customers may pursue minor individual disputes without the arbitration process.
Class Action Waiver
All claims must be brought on an individual basis only. Both the customer and North Lawn Care LLC expressly waive the right to participate in:
- Class actions or class arbitrations
- Consolidated or representative actions
- Private attorney general actions
An arbitrator may award relief only to the individual party bringing the claim and may not award relief to any other person or entity.
Jury Trial Waiver
To the fullest extent permitted by law, both parties waive the right to a jury trial for any dispute relating to services provided under these Terms or this agreement.
Arbitration Procedures
Any arbitration conducted under this agreement will:
- Be conducted by a neutral, independent arbitrator
- Take place in Erie County, New York
- Be conducted on an individual basis only
- Allow a reasonable exchange of relevant information between the parties
- Result in a written decision that is final and enforceable in a court of competent jurisdiction
Each party shall bear its own legal fees and costs unless the arbitrator awards fees under applicable law.
Limitation on Claims Period
Any claim or dispute arising from services or these Terms must be filed within one (1) year of the event giving rise to the dispute. Claims filed after this one-year period are permanently time-barred, regardless of any otherwise applicable statute of limitations.
Survival
This arbitration agreement and all waivers contained herein survive:
- Completion of services
- Cancellation of your account or subscription
- Termination of the customer relationship for any reason
Entire Agreement
These Terms of Service constitute the entire agreement between you and North Lawn Care LLC with respect to the subject matter herein. They supersede all prior or contemporaneous communications, representations, understandings, or agreements — whether written or oral — between the parties relating to lawn care services or use of our website.
- No Verbal Modifications: No verbal representations, promises, or commitments made by any employee, crew member, or representative of North Lawn Care shall modify, supplement, or override these Terms. Any modification to these Terms must be made in writing and published at thenorthlawncare.com/terms.
- Severability: If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Waiver: The failure of North Lawn Care to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future.
Website & Intellectual Property
All website content, including text, graphics, videos, logos, and branding, is the property of North Lawn Care LLC. By using our website, you agree not to:
- Copy, redistribute, or use our media (photos/videos) for commercial purposes without written consent.
- Attempt to interfere with website functionality or security.
- Use our online booking or payment systems for fraudulent purposes.
Changes to Terms
North Lawn Care reserves the right to update or modify these Terms at any time. The most current version will always be posted at thenorthlawncare.com and becomes effective immediately upon publication.
Continued use of our services following any such changes constitutes your acceptance of the revised Terms.
